DOJ to Kinder: Big Talk Can't Mask the Real Problems With Your Political Lawsuit

The Department of Justice filed a new memo Friday responding to Lt. Governor Peter Kinder's January 25 filing begging the judge not to dismiss his political lawsuit for its many flaws.  Kinder, attorney Thor Hearne and Kinder's co-plaintiffs made a few new claims in their latest filing, and the DOJ dissected those as it continues to assert that Kinder & Co. (1) lack the standing to make a number of their claims, (2) claim to have been harmed by portions of the Affordable Care Act that haven't taken effect yet, and (3) rely on factually inaccurate understandings of the law.

Last week, a federal judge dismissed a similar political lawsuit filed by Mississippi's Lieutenant Governor because he lacked the standing to sue.
