Fray At The Fringe: Cynthia Davis Listed In Affidavit Accusing Orly Taitz Of Demanding False Testimony
Just when you thought the never-ending birther drama couldn't get any weirder, it does.
As reported by The Washington Independent and Politico, an also-crazy man named Lawrence Sinclair is sending a sworn affidavit to the US District Court handling the birther lawsuit from Reps. Tim Jones and Cynthia Davis, alleging that lawyer Orly Taitz asked him to lie under oath for their case.
Specifically, Sinclair alleges that Taitz asked him to testify (1) "that three members of Obama's church were murder [sic]" and (2) that "you can identify a birth mark on Obama." Sinclair says he refused both requests.
What Politico and The Washington Independent did not report (yet) is that Cynthia Davis appears -- by name -- in Sinclair's affidavit.
Sinclair alleges that Davis was in a meeting with Taitz and a Lucas Smith just before, and perhaps during, Taitz' alleged request for false testimony. According to Sinclair, their conversation happened the day before Davis appeared at a press conference with Taitz in front of the federal courthouse in Santa Ana.
From Sinclair's affidavit:
Upon arriving at 29839 Margarita Pkwy Suite 100, I was met by Plaintiff(s) Attorney Orly Taitz in addition to a female introduced to me as Cynthia Davis and a male introduced as Lucas Smith. At this time all four of us entered the office of Suite 100.
Lucas Smith, you may recall, is the man who swears he went to Mombassa and found Obama's birth certificate; his forgery was the second fraud introduced by Davis, Tim Jones and the other birther plaintiffs in their case.
Rep. Davis did not respond to my request for confirmation or comment.
Sinclair's affidavit may be found below, with Davis' name appearing on page 3. He summarizes his accusations on his blog.
Later today I will be faxing to the United States District Court in Santa Ana, California as well as to the U.S. Attorney’s Office an Affidavit informing Judge Carter that on September 7, 2009 Orly Taitz did knowingly and intentionally ask me to appear before his Court on September 8, 2009 and give knowingly false testimony for the purpose of obtaining “expedited discovery,” and to gain publicity for my book.
I have made it clear from my first going public on YouTube January 17, 2008 that I will stand by the truth and would not allow anyone to misrepresent my statements nor would I be dishonest in any way. Orly Taitz as an officer of the court engaged in behavior that if allowed to go unquestioned will harm any and all valid claims made on Barack Obama’s eligibility now or in the future. In the words of an Orly Taitz supporter, “She can’t lie and ask others to lie at the same time accusing Obama of lying. Lets get to the truth but we have to be honest in doing so.”
To be clear, Sinclair is himself a lunatic with a long history of outrageous behavior. But it's still very odd to see an elected representative (even Davis) anywhere near this junk, and we do know that Davis was in Santa Ana with Orly Taitz last week.
Taitz addressed the allegations (and others) indirectly this morning on her blog in a post titled, "Please don’t listen to vicious rumors." She writes:
I am getting close to removing the usurper and there are more and more vicious rumors about me and my whole family. It is 5:30 in the morning and I had to cut on sleep yet again to take some time and debunk all those vicious rumors.
First, there was a rumor that there is a a declaration by Larry Sinclair filed with court. Please, go on Pacer, it is a public record. There is nothing there, no such declaration. People need to understand that a person cannot just come from the street and file a declaration or an affidavit. It has to be filed by a party to the action. Either I, as an attorney for the plaintiffs or attorney for the defendants, assistant US attorney would file something. Neither I nor US attorney filed any such affidavit or declaration.
Taitz is right that Sinclair actually hasn't filed the affidavit with the court yet -- he just said he was faxing or mailing it, and he's not a party in the case, so it's hard to imagine how his accusations would be listed in the docket anyway. But it's worth noting that Taitz doesn't actually address Sinclair's accusations.
So bizarre.

In other Orly Taitz news, a US District Court Judge in Georgia threw out a similar birther lawsuit filed by Taitz, and said she would be "subject to counsel sanctions for bringing any future actions in his court which are similarly frivolous."
