Ten days earlier, on September 7, Gov. Blunt selected Court of Appeals Judge Patricia Breckenridge to be the state's newest Supreme Court judge.
The following was published the day before Eckersley asked if he should destroy his records:
Even before she [Breckenridge] was officially chosen, a number of conservative blogs and judicial reformers attacked her as somewhat of a sheep in wolf's clothing - a closet liberal despite her long-standing Republican credentials.
Several groups accused Gov. Matt Blunt of having "caved in. " Blunt himself offered her congratulatory words woven with reservations, saying she was "the best candidate of the three candidates submitted to me," and that he would "accept" her vow not to "legislate from the bench. "
It's uncertain how much attention Blunt intends to pay to Breckenridge's future opinions; he declined repeated requests for an interview as did Breckenridge. But with the rhetoric swirling around her, Breckenridge could find her Supreme Court decisions facing special scrutiny in the coming months and years with observers watching her voting patterns to discern her true judicial philosophy. Although no one knows exactly what cases will reach the court during her time in office, at least a few upcoming hearings could be potential minefields, depending on their outcomes.
