Post-Dispatch Slams Kinder's Prospective Lawsuit: "A Colossally Wrongheaded Idea"

In that barren financial environment, Mr. Kinder wants to file a frivolous — and nakedly political — suit against the federal government.

It’s a colossally wrongheaded idea.

The Post-Dispatch editorial board is also highly critical of Sen. Jane Cunningham's proposed constitutional amendment that she hopes will spark a new round of frivolous lawsuits against the federal government.

Senate Joint Resolution 25, sponsored by Sen. Jane Cunningham, R-St. Louis County, is as bad an idea as the lawsuit Mr. Kinder wishes he could file — and equally unlikely to succeed, thanks to the U.S. Constitution’s supremacy clause. That’s the part of the Constitution that says that federal law prevails when state and federal laws conflict.

But winning isn’t really the point. This is really about taking a political stand — with taxpayers’ money.
